Patagonia has filed a case against Nordstrom in a U.S. District Court in Los Angeles for selling fake merchandise in its physical stores.

The company alleges that Nordstrom sold thousands of counterfeit Patagonia sweatshirts and t-shirts through its Nordstrom Rack stores, which resulted in trademark infringement, unfair competition, dilution, and copyright infringement. It also asked Nordstrom to pull the merchandise but to no avail.

“These counterfeit products prey on Patagonia’s reputation, misleading customers into buying poor quality products that were, on information and belief, made in factories with conditions that do not meet Fair Trade Certified requirements,” the suit alleged.

Nordstrom and Patagonia previously had a partnership that allowed the sale of the brand’s merchandise in Nordstrom stores. However, Patagonia chose not to renew its deal after discovering the fake merchandise in 2023.

Patagonia’s decision to sue Nordstrom marks the third time the brand has sued a major retailer for copyright infringement. In November 2022, Patagonia sued Gap for selling duplicates of its Snap-T pullover fleece, featuring a logo that imitated its “P-6” mountain skyline logo. And then, in October 2022, Patagonia sued Walmart and lifestyle apparel brand Robin Ruth USA for selling apparel featuring its P-6 Trout logo and artwork and simply replacing its brand name under the logo with the word “Montana.”
